1. Introduction & Acceptance of Terms

These Terms & Conditions (“Terms”) govern your use of moderncollectibles.co.uk (the “Site”) and any purchase you make through it. By browsing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

By accessing, browsing, or placing an order on our online store, you confirm that you are at least the age of majority in your country, state, or province of residence, or that you have obtained the explicit consent of your parent or legal guardian to use this website. If you are under the legal age required to enter into a binding contract in your jurisdiction, you must not purchase goods from this website without parental supervision. We reserve the right to cancel any order if we reasonably believe the customer does not meet the legal age requirements of their home country.

These Terms are specifically designed for consumers (individuals buying products for personal, non-business use). If you are a business customer, please contact us directly as different legal rules apply. We recommend that you print or save a copy of these Terms for future reference.

Our store is hosted through the WooCommerce platform (Automattic Inc.) which allows us to sell our products to you.

2. Acceptable Use

  • Access: The use and access of this website are permitted on a temporary basis. We reserve the right to withdraw, amend, or restrict access to our online store at any time without notice. We will not be liable if for any reason this website is unavailable at any time or for any period.
  • Lawful Use: You must use our online store for lawful purposes only and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the website. You are prohibited from using the site to transmit or upload malicious software, viruses, or any material that is technologically harmful. Breach of this provision may constitute a criminal offence under the Computer Misuse Act 1990, and we will report any such breach to the relevant law enforcement authorities.

3. Product Description and Ordering

Each piece we sell is part of a strictly limited, individually numbered edition, produced on aluminium or slate and finished by hand. Once an edition sells out, it is not reopened or reprinted.

Due to the handmade nature of each piece, minor natural variation in colour, grain, or finish between individual units should be expected and is not considered a fault.

  • Condition and Imagery: Because our autographed items are signed individually by hand, minor variations in signature placement, ink density, or item positioning may occur. Website images are strictly for illustrative purposes, and such minor variations do not constitute a defect.
  • Product Images: The images of the products on our website are for illustrative purposes only. We make every effort to display colours accurately, but we cannot guarantee that your device’s screen perfectly reflects the true colour of the goods.
  • Order Acceptance: When you place an order, you will receive an acknowledgement email. This is not an acceptance of your order. A legally binding contract between us is only formed when we send you a confirmation email stating that your goods have been dispatched.
  • Order Rejection:
    • We reserve the right, in our sole judgement, to limit or cancel quantities purchased per person, per household, per card account or appear to be purchased by dealers and resellers.
    • Anti-Bot and Fair Purchase Policy: You must place orders manually using standard web browsers. The use of automated software, scripts, buying bots, or scraping tools to monitor inventory, bypass checkout queues, or automate purchases is strictly prohibited.
    • Order Rejection: We reserve the right to refuse or cancel any order (for example, if the product is out of stock, if we identify an error in the price or description, or if we cannot obtain authorisation for your payment). If this happens, we will inform you and refund any money paid.

4. Pricing & Payment

  • Currency and Taxes: All prices shown on our website are in GBP £. For UK customers, prices include UK VAT where applicable.
  • Import Taxes and Duties: If you order items for delivery outside the United Kingdom, they may be subject to local import duties, customs fees, and taxes. You are solely responsible for paying all import duties and taxes levied by the destination country.
  • Price Changes: We reserve the right to change prices at any time, but changes will not affect orders already confirmed.
  • Payment Methods: Payment is processed securely at checkout through our payment provider(s); we do not store your full card details. Payment is taken at the time you place your order.
  • Cancellations: We reserve the right to refuse or cancel an order where payment cannot be verified or authorised.

5. Delivery and International Shipping

  • UK Delivery: We deliver to addresses across the UK. Estimated delivery timeframes and charges will be clearly displayed at the checkout before you complete your order.
  • Please allow additional handling time before dispatch during high-demand drops.
  • Worldwide Shipping: We ship to select international destinations. International deliveries may be subject to longer transit times. Please note that we do not currently ship to the EU.
  • Import Duties, Taxes, and Fees: If you order products for delivery outside the UK, your order may be subject to import duties, customs fees, and local taxes once the shipment reaches your country. You (the customer) are solely responsible for paying all customs duties, import clearance fees, and local taxes. We have no control over these charges and cannot predict their amount.
  • Delivery Delays: If our supply of the products is delayed by an event outside our control (such as postal strikes or customs delays), we will contact you as soon as possible to let you know. We are not liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to end the contract and receive a refund for any products you have paid for but not received.
  • Risk in the goods passes to you on delivery.

6. Product Care

Aluminium and slate pieces should be kept away from direct, prolonged sunlight and excessive moisture, and cleaned only with a soft, dry cloth. Any care instructions included with your piece form part of these Terms.

8. Changes and Modifications

Pricing of our products is subject to change without notice.

Products and/or services can be modified or discontinued at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance.

9. User Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please notify us immediately of any unauthorised use of your account.

10. Online Payments

All payment transactions are conducted on the WooPayments gateway. No payment details are held on the Web Site or disclosed to Modern Collectibles.

11. Accuracy of Information and Website Content

  • General Content: The content on our website (including product guides, blogs, and articles) is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.
  • Accuracy of Descriptions: While we make every effort to ensure that all details, descriptions, and prices of products appearing on the website are accurate, errors may occur. If we discover an error in the price or description of any goods you have ordered, we will inform you of this as soon as possible.
  • Right to Correct Errors: In the event of an error, we will give you the option of reconfirming your order at the correct price/specification or cancelling it. If we are unable to contact you, we will treat the order as cancelled and refund you in full.

We reserve the right to modify the contents of this site at any time, but we have no obligation to update or correct any information. You agree that it is your responsibility to monitor changes to our site.

  • “As Is” Basis: This website and its content are provided on an “as is” and “as available” basis. While we strive to ensure that the information on our website is accurate, complete, and up to date, we do not guarantee or warrant that it is free from errors, omissions, or inaccuracies.

We may suspend, withdraw, or restrict the availability of all or any part of our website for business and operational reasons (such as maintenance). We will try to give you reasonable notice of any major suspension.
  • Viruses and Security: We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for configuring your own information technology and computer programs to access our website, and you should use your own virus protection software.

All content on the Site — including artwork, photography, text, logos, and site design — is owned by or licensed to Modern Collectibles and is protected by copyright and other intellectual property laws. All such rights are reserved. You may not reproduce, distribute, or create derivative works from this content without our prior written permission. You may print off one copy, and may download extracts, of any page(s) from our site for your personal use only.

14. Limitation of Liability

To the fullest extent permitted by law, Modern Collectibles will not be liable for any indirect or consequential loss arising from your use of the Site or purchase of our products.

  • Our maximum liability to you for any loss or damage arising in connection with an order is strictly limited to the total purchase price of the item in question.
  • We are not liable for any indirect loss, loss of investment value, or disappointment relating to the perceived future market value of limited-edition memorabilia.
  • Foreseeable Loss Only: If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
  • No Liability for Business Losses: We only supply products for domestic and private use. If you use the products for any commercial, business, or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  • Unlawful Exclusions: Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for:
    • Death or personal injury caused by our negligence or the negligence of our employees;
    • Fraud or fraudulent misrepresentation;
    • Breach of your legal rights in relation to the products (including your right to receive products that are of satisfactory quality, fit for purpose, and match their description);

  • Your Liability to Us: You agree to indemnify Modern Collectibles, our directors, employees, and agents, against any reasonable claims, costs, losses, expenses, or liabilities (including reasonable legal fees) that we incur arising directly out of:

    • Your violation of any law or the rights of any third party.
  • Consumer Exception: This responsibility does not apply to the extent that any loss or damage we suffer is caused by our own breach, negligence, or wilful misconduct.

  • Effect on Existing Orders: Termination of your website access will not affect any legally binding contract for products we have already accepted and dispatched to you prior to the termination date.

20. Entire Agreement

  • The Full Contract: These Terms, together with our current website prices, delivery details, contact details, and Privacy Policy, set out the whole of our agreement relating to the supply of the goods to you by Modern Collectibles Limited.
  • Protection Against Misrepresentation: Nothing said by any sales person on our behalf should be understood as a variation of these Terms or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
  • The entire agreement and understanding between you and us dictate your use of the service.
  • The failure of us to exercise or enforce any part of these Terms and Conditions shall not constitute a waiver of such right or provision.

21. Invalidity (Severability)

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

22. Governing Law

These Terms, their subject matter, and their formation are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections available to you in your country of residence.

23. Dispute Resolution and Good Faith

  • Amicable Resolution: If a dispute, controversy, or claim arises out of or relates to these Terms, the breach thereof, or your purchase of products from us, both you and we agree to first attempt to settle the matter amicably and in good faith.
  • Notification of Dispute: Before initiating any formal legal proceedings, the party raising the dispute must notify the other party in writing, providing a clear description of the issue and the remedy sought. You can notify us by emailing info@moderncollectibles.co.uk.
  • Good Faith Discussions: Following receipt of this notice, we will both engage in good faith discussions within 30 days to try and find a mutually acceptable resolution.
  • Alternative Dispute Resolution (ADR): If we cannot resolve the dispute through direct discussion, we may mutually agree to use an Alternative Dispute Resolution provider (such as an independent mediator or ombudsman scheme) to settle the matter without going to court.
  • Right to Court Action: If the dispute is not settled amicably, or if either party refuses to participate in good faith discussions, either party remains free to pursue legal remedies through the courts in accordance with the Governing Law clause.

We may update these Terms from time to time. Changes will be reflected by an updated “last updated” date at the top of this page, and continued use of the Site after changes constitutes acceptance of the revised Terms.
